Defining "Driving While Intoxicated"

If a motorist is pulled over under suspicion of DUI and is found to have a blood alcohol content (BAC) of 0.08% or higher, they can be arrested for driving while intoxicated. An individual's BAC can also be calculated through a blood test, as can the milligrams per liter (mg/L) of intoxicating drugs in a driver's bloodstream. A motorist can be arrested for intoxicated driving if a blood test reveals the following:

  • 0.02 mg/L or more of cocaine
  • 0.1 mg/L or more of methamphetamine
  • 0.01 mg/L or more of phencyclidine
  • 0.1 mg/L or more of 3, 4-methylenedioxymethamphetamine (MDMA)

Penalties for Various DUI Offenses

The Virginia Code increases the penalties for each subsequent DUI conviction within 5 or 10 years.     • Mandatory minimum fine of $500
    • Jail for 1-12 months
    • Twenty days mandatory minimum sentence
    • Driver's license revocation for three years
  • Second Offense within 5-10 Years of a Prior Offense
    • Mandatory minimum fine of $500
    • Jail for up 1-12 months
    • Ten days mandatory minimum sentence
    • BAC of 0.15% or higher – Additional mandatory minimum period of 10 days
    • Driver's license revocation for three years
  • Third Offense within a 5-Year Period
    • Felony
    • Mandatory minimum fine of $1,000
    • Mandatory minimum sentence of six months
    • Mandatory, indefinite license revocation
  • Third Offense within a 10-Year Period
    • Felony
    • Mandatory minimum fine of $1,000
    • Mandatory minimum sentence of 90 days
    • Mandatory, indefinite license revocation
    • Permanent forfeiture of your vehicle if you are the sole owner
  • Fourth or Subsequent Offense within a 10-Year Period
    • Felony
    • Mandatory minimum term of imprisonment of one year
    • Mandatory minimum fine of $1,000
    • Up to three years of probation
