Drug Crimes

Representation for Drug Distribution and Possession Cases

According to the Virginia Code §§18.2-250-18.2-256, drug crime charges can range from simple marijuana possession to serious possession with intent to sell. If you are found with drugs on you or your property in the state of Virginia, you will be arrested and charged accordingly. If you have been arrested, it is vital that you work hard to retain the representation of a dedicated Virginia Beach criminal defense attorney as soon as possible. At my firm, I have the experience you can rely on to ensure that you reach an amicable resolution in a swift amount of time. Do not hesitate to contact a Virginia Beach criminal attorney from Thoman Law, PLLC.

Drugs are classified in schedules according to United States Department of Justice Drug Enforce Administration guidelines. In accordance with these rules, each drug is listed in a schedule from I to V with V having the lowest potential for abuse and I having the highest. Some examples of drugs classified in these schedules include:

Schedule I
Marijuana, peyote, heroin, LSD and Ecstasy

Schedule II
Codeine, Adderall, Ritalin, morphine, opium and Demerol

Schedule III
Vicodin, Tylenol with codeine, ketamine, steroids and Suboxone

Schedule IV
Xanax, Klonopin, Ativan and Restoril

Schedule V
Cough prescriptions such as Robitussin and sleeping aids such as Nyquil

Although many of these drugs can be obtained over the counter or by prescription, possessing large dosages can still be considered a felony, especially if you are buying with intent to sell. Prescription fraud is a huge concern for doctors and pharmacies, and you may be charged with a drug crime if you are engaged in fraudulent activity. Street drugs such as marijuana, heroin and Ecstasy are all illegal and any amount found in your possession, on your property or within your reach can leave you vulnerable to serious penalties including prison time, fines and probation.

Search and Seizure Laws

If a police officer has a valid concern that you may be in possession of an illegal substance, they must first ask for your consent to search you and your property. It is against the law for an officer to search your property without your consent or without a court-authorized search warrant. An officer is also not allowed to seize your property without first searching or observing visible evidence that you were in direct possession of illegal substances. If an officer asks to search you or your property, you can say no and ask to speak with an attorney. If your attorney finds that your rights were violated during an illegal search and seizure, this information may be used in your defense.
